MPC Music Co., Ltd.

MPC is a non profit making organization formed in 2003 to license and control of its communication to the public right for members of two organizations namely MCT and Phonorights. Music Copyright Thailand Limited (MCT) organization established in 1994, which represents international and Thai musical composers and authors for copyrighted musical work of its members and the members of some 30 affiliated foreign societies. MCT is a member of CISAC (The International Confederation of Societies of Authors and Composers) Phonorights (Thailand) Limited the sound recording copyright owners over than 10,000 labels or 90% of all copyright owners of sound recording worldwide. Phonorights also work closely with The International Federation of Phonographic Industry (IFPI).

MPC grants licenses for any person or business that communicates the music of its members to the public. MPC facilitates the music user to apply for licence at only one place for the convenience of the users such as broadcasters and commercial premises. Currently, MPC has licensed Airline, radio stations, TV stations, hotels, restaurants, bars, pubs, disco, karaoke, etc. After cost deduction MPC distribute all the royalty back to the copyright owners/holder.

Meaning of "Communication to the Public"

According to Copyright Act BE 2537, means making the work available to public by means of performing, lecturing, preaching, playing music, causing the perception by sound or image, constructing, distributing or by any other means.

Who is required to pay ?

Anyone who broadcast, plays recorded or live music to the public needs the permission from the copyrights owner to protect them from infringement. The business that publicize those work such as: Radio/TV Broadcaster, Webcaster, Discotheque, Pub, Nightclub, Club, Dance School, Dance Center, CAFE, Coffee Shop, Hotel, Restaurant, Shop, Department Store, Office Complex, Sport Club, Cinema, Art Gallery, Theater, Exhibition Show, Fashion Show, Concert or Health Center etc.

To publicize, communication to public or public performance mean anywhere of copyright member-only club as well.

What kind of rights that MPC license ?

Right in the musical work is the right in the song tune, rhythm or lyric that the author or composer arranged or composed. Right in the sound recording means right in the work of music, sound of a performance or any other sound recorded on any kind of material.

What does the "sound recording and musical work" cover ?

Musical work covers the music with tune, whether it has lyric or not, and can be in any form such as sound recording, audiovisual, movie or concert. Sound recording includes devices such as CD, VCD, Minidisk, DVD or even computer files such as MP3 or MIDI file.

When do I need a licence ?

Whenever the music is heard in the public, the person who made it happen must apply for the licence. For example, those shops that play music through stereo, cable TV programs, and karaoke jukebox as well as playing live music should request permission from the copyright owner.

In general, organizers of events at which music is publicly used are responsible for securing would be jointly and severally liable.

PART 3

COPYRIGHT PROTECTION

Section 15 . Subject to Section 9, Section 10 and Section 14, the owner of copyright has the exclusive rights of: -

(1) Reproduction or adaptation,
(2) Communication to public,
(3) Letting of the original or the copies of a computer program, an audiovisual work, a cinematographic work and sound recordings,
(4) Giving benefit accruing from the copyright to other persons,
(5) Licensing the rights mentioned in (1), (2) or (3) with or without conditions provided that the said conditions shall not unfairly restrict the competition.

Whether the conditions as mentioned in sub-Section (5) of the paragraph one are unfair restrictions of the competition or not shall be considered in accordance with the rules, methods and conditions set forth in the Ministerial Regulation.

PART 5

INFRINGEMENT OF COPYRIGHT

Section 27 . Any of the following acts against a copyright work by virtue of this Act without the permission in accordance with Section 15 (5) shall be deemed an infringement of copyright:

(1) Reproduction or adaptation,
(2) Communication to public,

Section 28 . Any of the following acts against an audiovisual work, a cinematographic work or a sound recording copyrightable by virtue of this Act without the permission in accordance with Section 15(5) whether against the sound or image shall be deemed an infringement of copyright:

(1) Reproduction or adaptation,
(2) Communication to public, public,
(3) Letting of the original or copies the work

CHAPTER 8

PENALTIES

Section 69 . 28, Section 29, Section 30 or Section 52 shall be inflicted with a fine from twenty thousand Baht up to two hundred thousand Baht.
If the offence in paragraph one is committed with the commercial purpose, the offender shall be inflicted with imprisonment from a term of six months up to four years or a fine for one hundred thousand Baht up to eight hundred thousand Baht or both imprisonment and fine.

Section 70 . inflicted with a fine from ten thousand Baht up to one hundred thousand Baht. If the offence in paragraph one is committed with the commercial purpose, the offender shall be inflicted with imprisonment from a term of three months up to two years or a fine for fifty thousand Baht up to forty hundred thousand Baht or both imprisonment and fine.
